Waivers and Training Agreements for Personal Trainers and Gyms
Fitness professionals ask clients to push their bodies, and that makes paperwork part of doing the job responsibly. A liability waiver, a health questionnaire and a clear training package agreement protect both the trainer and the client. Codec Document lets clients complete and sign them from their phone before they arrive, instead of on a clipboard at the front desk.
Clipboard waivers get lost, skipped or signed without reading
Paper waivers are signed in a rush, stored in a box and impossible to find the day you need one. Package terms are explained verbally, and clients who stop coming ask for refunds on sessions they did not use. Health questionnaires are skipped because nobody wants to fill them in at the door. A digital process sent after booking fixes all three: the client reads at home, signs on their phone and you have a record you can find in seconds.
How it helps personal trainers
Waivers signed before the first session
The client receives the waiver when they book and signs from their phone, so the first session starts with training, not paperwork.
Health questionnaires on record
A readiness questionnaire the client completes and signs, so you know about injuries and conditions before designing a program.
Package and membership terms
Number of sessions, expiration, cancellation window and refund policy, signed when the client buys the package.
Contractor agreements for your trainers
Studios that work with independent trainers can keep their agreements, schedules and insurance requirements on file.
Waiver enforceability varies by state
Most states enforce clear, conspicuous liability waivers for ordinary negligence in recreational and fitness settings, but not for gross negligence or intentional conduct, and a few states are much stricter. Virginia, for example, has long treated pre-injury releases of personal injury claims as void, following Hiett v. Lake Barcroft Community Association (1992). The waiver must name the activity and the risks in plain language. Electronic signatures on waivers are valid under the ESIGN Act, 15 U.S.C. § 7001; the enforceability question is about content and state law.
The waiver in the box
A boutique studio in Denver had a client injure a shoulder in a group class. The studio insurer asked for the signed waiver. It was somewhere in a box of three years of paper forms. It took two days to find, and it turned out the client had signed an old version. The studio moved to digital waivers sent at booking, always on the current version, and can now produce any client waiver in under a minute.

- The refund policy for unused sessions.
- Permission to use photos or progress data, if you plan to share them.
Questions people ask about this
Can clients sign waivers before they arrive?
Yes. Send the waiver when they book; they sign from their phone and arrive ready to train.
Can a parent sign for a minor?
Yes. Add the parent or guardian as the signer on the minor waiver.
Can I update my waiver and have everyone sign the new version?
Yes. Send the updated version to all active clients in bulk and track who has signed it.
Is an electronically signed waiver valid?
The electronic signature is valid under the ESIGN Act. Whether the waiver is enforceable depends on its wording and on your state law.
Do I need a new waiver every year?
Not necessarily, but a waiver that reflects your current services and your current business name is stronger than an old one. Many trainers ask active clients to sign the current version once a year or whenever the services change, for example when adding outdoor sessions or new equipment. Keeping each signed version with its date shows exactly what the client accepted and when.
