State licensing rules require signed records

Each state licenses childcare and sets minimum standards, including which records must be kept for each child. Texas Administrative Code, Title 26, Chapter 746, for example, sets minimum standards for licensed child-care centers, including admission information, emergency contacts and parental consent for medication. Check your state licensing rules for which forms are required and whether electronic signatures and records are accepted; under the ESIGN Act, 15 U.S.C. § 7001, and state UETA laws, electronic signatures generally have the same effect as handwritten ones unless a specific rule says otherwise.
