Notice periods for month-to-month tenancies
Notice periods vary by state. In California, a landlord generally must give 30 days' notice to terminate a tenancy of less than a year and 60 days for longer tenancies (Civil Code § 1946.1), and just-cause rules under § 1946.2 apply to many units. In Texas, Property Code § 91.001 requires one month's notice unless the parties agree otherwise. Rent increase notice rules, such as California Civil Code § 827, apply separately. The Electronic Signatures in Global and National Commerce Act, 15 U.S.C. § 7001, provides that a signature, contract or record may not be denied legal effect solely because it is in electronic form, and every state except New York has adopted the Uniform Electronic Transactions Act; New York reaches the same result through its Electronic Signatures and Records Act.
